Windows MSDN ISOs do not carry any license, and they are distributed by MS as-is. Essentially unlicensed Windows installations are like evaluation or demo. If this software can be used out-of-the-box without further proof of owning a license, then it's warez.
That (correct IMO) logic in theory should be applicable to any SW that's useless if not unlocked with a serial number, an online activation or whatever mean that provides the access to full functionality. Then there are the EULAs sometimes crazy, sometimes not fully valid in various countries and so on. Say the eula of VMware even forbids to publish benchmarks (of a regularly licensed product) which is likely BS in most countries, nevertheless you don't find benchmarks in any website because site's owners don't want to risk a trial with someone as big as Dell....
Ok, so I did some digging, Parted Magic is technically free software (as in, freedom) but pay to download. Similar to Red Hat linux which is "free" but pay to support. So I don't think it counts as warez. Of course, I may be wrong.
If you pay for the download only and the software itself is free of any license requirement (e. g. GPL or similar), then, it's not Warez. However, it is a really dumb way by them of handling things. Either something is free, or it isn't. If one Samaritan pays for the download and then offers a mirror for free, what did they achieve? Server costs? Provide a Torrent, it will distribute by itself.
Well MS since the days of DOS acted this way, unofficially, and became one of the richest company in the world. REDHAT, SUSE & C. aren't exactly poor either. IBM that initially pretended to sell each copy of OS2 was forced to left the PC arena in few years... Apple pretended to sell even the mother of Jobs, survived just because the MP3.
AFAIK, they are forced to do that because it is linux based and Linux is GPL licensed (cannot be used on non-free software)
