Hi, this is my first post in this forum...
I want to get a legal copy of Windows 8 by using the Upgrade Assistant.
my question is: Can I get a legal copy of windows 8 if I don't have a legal copy of windows 7 ? and what about a clean installation of windows 8 by using this method ?

You can use this assistant from unactivated 7 or from 8 with Windows 7 compatibility applied. You can have Windows 7 in notification mode(unactivated) and upgrade assistant will do his job. After You finalize download the assistant will ask you if you want to install Windows now or create boot media. The second choise has for me: I done a DVD and booted from it.All goes good and now I have clean W8 installation and DVD 100% untouched for future instalations.Yes,your purchased Windows and DVD will be 100% legal.

    Installing it and not activating..

But it isn't really needed when you can install a retail version of the Windows 8 and use your upgrade key without problems.

Sorry, I am lost now. As I know, to get a legal copy of windows 8, I should download it from Microsoft through the Upgrade Assistant, right ?
When I enter my credit card info, I should get a key and a download link right ? So what is a retail version anyway ?

Retail is the version that you'll download, burn and install.

Or use the credit card into a PayPal account, but there's the same result...

It's an upgrade license. If you don't have a legal license for the previous OS then the Windows 8 license will be 0% legal.

Not on the Microsoft servers.. But you only can prove that the license is genuine showing data about the previous license (if you're using the OS in a company).

If it is legal, nobody will buy the oem or full retail versions. And Microsoft will not be trying to restrict what most of us are attempting to do here; and that is to learn how activations work

Ok I purchased the Upgrade, it cost me 41.99 $ And I have a product key now.
The problem is I get a downloader that will begin the dwonload in my office. I want to resume the download at home. I am on a desktop computer. So how I can do these ? is there a place that this downloader put the files in, so I can copy them and pasting them in my home computer ?

Look in your confirmation mail, there is a link to re-download te upgrade assistent. You will need to input your Win8 key before dl can start.

Yes there is a link to re-download, but this simply download the upgrade assistant again (with different file name (Windows8-Setup.exe) where the upgrade assistant name was Windows8-UpgradeAssistant.exe). this new file will ask me of the product key, and then it download again...
I found that he put this files in: %UserProfile%\AppData\Local\Microsoft\WebSetup directory.
I am downloading now, but after a while, I will disconnect and go to home, I will copy this directory in my flash memory and restore it in my home computer. I hope that I can resume the download from my home...
