You think it's disabled but it's not, go look in Settings/Privacy/Feedback & diagnostics and look what's set under Diagnostic and usage data.
Ok, right now, after i upgraded my Retail Win 8.1 and did a clean install for the 10240 i have a retail Win 10. But if this licence is linked in the MS servers with my Hardware ID and i change something like my VideoCard or motherboard, i'll loose the licence in a new clean install?
I didn't talk about free upgrade. I talk about new build with fix bugs, like notifications disappear after close Notification Center.

We don't know. The activation system isn't really designed for non-oem systems that actually change motherboards. I think they COULD keep the activation by checking hard drive serial and ip address and such, but I don't know. This is one of those things that MS doesn't exactly talk about.
Let me put it this way. I normally do upgrades on a VM since my Windows 10 build is on a VHD which then goes onto activating itself. Once MS stopped the tester activations suddenly I had an unactivated device when I "booted to VHD". It considers the VM and my normal environment to be 2 different machines. (naturally)
I don't know. You'd think that they'd decommission the old hardware activation and commission the new hardware, but *shrug*
