You can't upgrade if you boot from the disk, upgrades are always started from inside of windows, running setup.exe from the disk

    Thanks

Also it shows me only been able to 'keep personal files only' or 'keep nothing'

    Is this right?

Thought there was an option to keep 'Windows settings, personal files and apps'?

Depends if you are running 8 or 8.1 preview, only 8 can keep everything, but not sure about DVD install, that was said about the official update from the store

Everything is unknown about this type of update, only official update from the store has been talked about, we're not supposed to update this way

so if I have a laptop that has windows 8 already installed, I can just do a update from this iso and replace the key then do the slmgr -ato command or something then it will be activated because it has a "retail" oem key?

search the web for instructions on how to configure secure boot. That's a system issue, not OS issue.

Yes, and select the keep nothing option. Then after install, run cleanmgr and select system files to remove windows.old from your hard drive.
