I don't think so. It's run through an IPv6 tunnel from HE, who are acting as an ISP in this case. If MS can get an ISP to disconnect a client for abuse reasons, so will they be able to get HE to shut down the tunnel. It's just a matter of time.
Good finding. Although it is easy to maintain and hard to find out, MS has all necessary tools to screw such servers. BTW, it will be interesting to know their source of KMS server key...

it seems the benderrodriguez-1-pt.tunnel.tserv28.waw1.ipv6.he.net server has been shutdown as well it does even let me ping the server
